Overview

Alton Teaches LLC ("us," "we," or "our") operates this learning platform, including all information, tools, courses, labs, digital downloads, and services available through it (the "Service"), conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By accessing or using the Service - including browsing, creating an account, enrolling in a course, redeeming an access code, or making a purchase - you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions of this agreement, then you may not access or use the Service.

By agreeing to these Terms, you represent that you are at least 18 years of age, or that you are the age of majority in your state or province of residence.

  • Account sharing: strictly prohibited; may result in immediate termination without refund.

Section 1 - General Conditions

We reserve the right to refuse service to anyone for any reason at any time.

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within the Service.

You understand that your content (not including payment card information) may be transferred unencrypted and may involve transmissions over various networks and changes to conform and adapt to the technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer over networks and is handled by our payment processor; we never store your complete card details.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission from us.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Section 2 - Intellectual Property

The Service and all original content, features, course materials, labs, software, and functionality are and will remain the exclusive property of Alton Teaches LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Content License: Permission is granted to temporarily download one copy of any downloadable materials (such as PDF files, workbooks, and other digital resources) provided through the Service, and to access and use course materials, for personal, non-commercial, transitory use only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials;
  • Use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  • Remove any copyright or other proprietary notations from the materials;
  • Transfer the materials to another person or mirror the materials on any other server;
  • Use course content or any other materials from the Service to train, develop, or improve any machine learning or artificial intelligence model without our express written permission;
  • Reverse engineer, decompile, or disassemble any aspect of the Service.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Alton Teaches LLC at any time. Upon terminating your access to or use of the Service, or upon termination of this license, you must destroy any downloaded or saved materials in your possession, whether in electronic or printed format.

Section 3 - Educational Disclaimer

Our courses, labs, and content contain the opinions and ideas of our instructors and are intended to provide helpful and informative material on information technology and related subjects. The information, practice exercises, and scenarios presented are strictly for educational purposes. The strategies and information presented may not be suitable for everyone and are not guaranteed or warranted to produce any particular results, including any particular certification, employment, or career outcome. If you wish to apply the ideas contained in the Service, you are taking full responsibility for your actions.

Liability Disclaimer: We expressly disclaim all responsibility for any liability, loss, or risk, personal or otherwise, which is incurred as a consequence, directly or indirectly, of the use and application of any of the contents of the Service. We do not assume and hereby disclaim any liability to any party for any loss, damage, or disruption caused by errors or omissions, whether such errors or omissions result from accident, negligence, or any other cause.

Section 4 - Products and Services

We offer the following products and services through the Service:

  • Individual Courses and Lab Packs: single purchases providing lifetime access to the course materials, including videos, labs, downloads, and supplementary resources associated with that product.
  • Bundles: bundled packages providing access to all products included within the bundle, either as a one-time purchase or as a subscription.
  • Digital Downloads: downloadable digital products including eBooks, PDFs, workbooks, and other educational materials. These are delivered digitally and do not include physical goods.
  • Subscriptions (including the All-Access Pass): a recurring subscription providing access to a designated set of products for as long as the subscription remains active and paid. Subscriptions renew automatically until canceled.
  • Access Codes: codes distributed with books, promotions, or gifts that grant access to specific products under the conditions configured for the code, including expiry dates, usage limits, and first-time-student restrictions.

Prices for our products and services are subject to change without notice. We reserve the right at any time to modify or discontinue any product or service, or any part or content thereof, without notice at our sole discretion. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance.

Section 5 - Refund Policy

  • Individual Courses, Lab Packs, Bundles, and Digital Downloads: if you are unsatisfied with your purchase for any reason, you may request a full refund within 14 days of the original purchase date, no questions asked. To request a refund, contact us at [email protected] within the applicable refund period.
  • Subscriptions: the 14-day refund policy applies only to the first payment. Subsequent renewal payments are non-refundable. You may cancel your subscription at any time through the billing management page or by contacting us at [email protected] to prevent future charges; previously charged fees for completed billing periods will not be refunded.
  • Access granted through redemption codes is free of charge and carries no refund value.

Section 6 - Accounts and Billing

Account Security and Sharing: your account is for your sole, personal use. Account sharing is strictly prohibited. You are allowed one account per person. You may not permit the Service to be used by anyone other than yourself. You agree to maintain the security of your password and accept responsibility for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. Violation of our account sharing policy may result in immediate termination of your account without refund.

Billing Accuracy: we reserve the right to refuse any order you place with us. You agree to provide current, complete, and accurate purchase and account information for all purchases. You agree to promptly update your account information, including your email address and payment information, so that we can complete your transactions and contact you as needed. You are responsible for any applicable sales tax, VAT, or other governmental fees associated with your purchase, which will be calculated and charged at checkout where required by law.

Payment Processing: purchases are processed by Stripe, acting as merchant of record. Payment, tax calculation, receipts, and invoices are handled on Stripe’s systems in accordance with the Payment Card Industry Data Security Standard (PCI-DSS). We do not store your complete credit card information on our servers.

Subscription Billing: if you purchase a subscription, you authorize recurring charges to your payment method until you cancel. You may cancel at any time through the billing management page. If a subscription payment fails, access associated with that subscription may be suspended or end when the paid period lapses.

Section 7 - Promotion, Coupon, and Access-Code Integrity

From time to time, we may offer promotional discounts, coupons, or access codes (collectively, "Promotions"). Promotions are offered at our sole discretion and may be subject to additional terms and conditions, including limitations on frequency of use, eligibility, or duration.

You agree not to exploit, manipulate, or reuse any Promotion in a manner inconsistent with its stated purpose or limitations, including but not limited to:

  • Reusing a Promotion intended for one-time or limited use;
  • Creating a new account or using additional email addresses to redeem a Promotion you have previously used or that is intended for new students only;
  • Canceling a purchase and re-purchasing to obtain a lower price through the same or a different Promotion;
  • Using a Promotion not intended for you or for an audience you do not belong to;
  • Sharing, publishing, or distributing a Promotion or access code to individuals or audiences for whom it was not intended;
  • Combining or stacking Promotions unless expressly permitted.

If, in our sole discretion, we determine that you have engaged in Promotion misuse or abuse, we reserve the right to revoke the Promotion and any access it granted, charge the full non-discounted price for the applicable product, suspend or terminate your account without refund, and restrict your eligibility for future Promotions. For purposes of this section, we may use any reasonable method to identify misuse, including matching account information such as name, email address, payment method, or network address across multiple accounts. We reserve the right to deny refund requests if we determine a Promotion was used in bad faith.

Section 8 - Account Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use the Service, or when you cease using the Service (noting that ceasing use does not automatically cancel a recurring subscription; see Section 6 for cancellation).

If, in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice. Upon such termination, you will remain liable for all amounts due up to and including the date of termination, and we may accordingly deny you access to the Service or any part thereof.

Sections of these Terms that by their nature should survive termination will remain in full effect, including but not limited to intellectual property provisions, the educational disclaimer, disclaimer of warranties, limitation of liability, and indemnification.

Section 9 - Prohibited Uses

In addition to other prohibitions set forth in these Terms, you are prohibited from using the Service or its content:

  • For any unlawful purpose or in violation of any laws in your jurisdiction;
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others;
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
  • To submit false or misleading information;
  • To misuse, exploit, or abuse any Promotion or access code in violation of Section 7;
  • To upload or transmit viruses or any other type of malicious code;
  • To collect or track the personal information of others;
  • To spam, phish, pharm, pretext, spider, crawl, or scrape;
  • To interfere with or circumvent the security features of the Service;
  • To use any content from the Service to train, develop, or improve any machine learning or artificial intelligence model without our express written permission;
  • To reverse engineer, decompile, or disassemble any aspect of the Service;
  • To permit the Service to be used by anyone other than yourself;
  • To circumvent any limitations imposed on your account, including any license, timing, or use restrictions;
  • To lend, sell, resell, lease, sublicense, transfer, or distribute access to the Service for the benefit of a third party;
  • To share, distribute, or make available course materials, videos, or any proprietary content to any third party.

You must not use the bandwidth and storage resources provided by us in an unreasonable and disproportionate manner. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

Section 10 - User Content and Community

Student Community: where the Service includes community features, such as course question-and-answer sections, students may post questions and comments and interact with other students and instructors. By participating, you agree to conduct yourself respectfully and professionally at all times.

Feedback and Submissions: if you choose to provide feedback, including any ideas, suggestions, concepts, processes, techniques, questions, answers, or other comments related to the Service ("Feedback"), we will own and may use such Feedback without any restrictions or obligations to you. You hereby waive any claim you have to ownership, compensation, or any other form of consideration for such Feedback.

Content Monitoring: we may, but have no obligation to, monitor, edit, or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, obscene, or otherwise objectionable, or that violates any party’s intellectual property rights or these Terms.

User Responsibilities: you agree that any content you submit will not violate any right of any third party, will not contain libelous or otherwise unlawful, abusive, or obscene material, and will not contain any computer virus or other malware. You may not use a false email address or pretend to be someone other than yourself. You are solely responsible for any content you post and its accuracy.

Section 11 - Disclaimer of Warranties

We do not guarantee, represent, or warrant that your use of the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and services delivered to you through the Service are (except as expressly stated by us) provided "as is" and "as available" for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Section 12 - Limitation of Liability

In no case shall Alton Teaches LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Service or any product procured using the Service, or for any other claim related in any way to your use of the Service, even if advised of the possibility of such damages.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Section 13 - Indemnification

You agree to indemnify, defend, and hold harmless Alton Teaches LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

Section 14 - Third-Party Links and Services

Certain content, products, and services available via the Service may include materials from third parties, and links in the Service may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of those sites, and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties. Please review the third party’s policies and practices before you engage in any transaction.

Section 15 - Severability

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

Section 16 - Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms and any policies or operating rules posted by us in connection with the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

You can review the most current version of these Terms at any time on this page. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes here. For material changes, we will make reasonable efforts to provide at least 30 days’ notice prior to new terms taking effect, either by email or by posting a prominent notice within the Service. Your continued use of or access to the Service following the posting of any changes constitutes acceptance of those changes.
